Terms and Conditions

These Terms and Conditions ('Terms') govern your use of the crypto asset will service operated by Mario Boss Ltd, a company registered in England and Wales with company number 12441354 and registered office at 20-22 Wenlock Road, London, England, N1 7GU ('Company', 'we', 'us', or 'our'). Crypto Will is a trading name of Mario Boss Ltd.

1. Service Overview

Mario Boss Ltd provides an online portal that allows users to enter partial crypto will information using guided forms on our secure, SSL-encrypted website. Our service stores only part of the necessary information required for crypto asset inheritance planning. The other part must be stored separately by the user with a chosen legal professional.

  • We store only partial information and do not store complete data that can be used alone to recover or access crypto assets
  • Our service requires a monthly subscription fee for continued storage and availability of your information
  • If payment ceases, the service becomes inactive and your stored information may become inaccessible
  • We do not guarantee that your will can be accessed or executed unless you have properly coordinated with your legal professional

2. Service Limitations and Supported Wallet Types

Our service supports standard cryptocurrency wallets but has specific limitations. We currently support:

  • Hardware wallets: Physical devices with seed phrase recovery (partial phrase storage only)
  • Software wallets: Mobile apps, desktop applications, online platforms, and exchange accounts (Coinbase, Binance, etc.)
  • Basic cryptocurrency holdings: Standard wallet addresses and access credentials

We do NOT support and cannot assist with recovery of:

  • Multi-signature wallets: Wallets requiring multiple private keys or co-signers
  • Staking positions: Locked or staked cryptocurrency that cannot be immediately accessed
  • DeFi protocols: Decentralized finance positions, liquidity pools, yield farming, or smart contract interactions
  • Advanced wallet features: Custom derivation paths, advanced multi-sig schemes, or time-locked contracts

If your cryptocurrency holdings involve unsupported wallet types or protocols, please consult with qualified legal and technical professionals for alternative inheritance planning solutions.

3. Eligibility and User Responsibilities

You must be at least 18 years old and legally capable of entering into binding contracts to use our service. By using our service, you represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • You will provide accurate and complete information
  • You will maintain the security of your account credentials
  • You will inform your chosen legal professional about our service and coordinate both parts of your crypto will data
  • You will seek independent legal advice regarding crypto asset inheritance planning

4. Legal Advice Disclaimer

IMPORTANT: Mario Boss Ltd is not a legal advisor and does not provide legal advice. Our service is a technology platform only. You must seek independent legal advice from qualified professionals regarding:

  • Crypto asset inheritance laws in your jurisdiction
  • Proper execution of wills and estate planning
  • Tax implications of crypto asset transfers
  • Compliance with local regulations and requirements
  • Coordination between our partial data and your legal documentation

5. Limitation of Liability and Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, Mario Boss LTD PROVIDES THE SERVICE 'AS IS' AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE SHALL NOT BE LIABLE FOR:

  • Loss of data, access, or crypto assets for any reason
  • Failure to successfully recover or transfer crypto assets
  • Service downtime, technical failures, or termination
  • Legal disputes with heirs, beneficiaries, or third parties
  • Misuse of the service or breach of security
  • Failure to coordinate with legal professionals
  • Any direct, indirect, incidental, special, or consequential damages

Our total liability to you for any claim arising from or relating to these Terms or the service shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

6. Payment Terms and Refunds

Our service requires a monthly subscription fee charged in advance. Payment terms include:

  • Monthly fees are charged at the beginning of each billing cycle
  • No refunds are provided for partial months or cancelled subscriptions
  • Failed payments may result in immediate service suspension
  • Price changes will be communicated 30 days in advance
  • You may cancel at any time, but access terminates at the end of the current billing period

7. Data Storage and Privacy

We employ industry-standard security measures to protect your partial data, including SSL encryption and secure data storage. However:

  • We cannot guarantee absolute security of any data
  • Our Privacy Policy governs data collection and processing
  • You remain responsible for the security of information stored with your legal professional
  • We may retain anonymised data for service improvement after account termination

8. Account Termination

We may terminate or suspend your account immediately for breach of these Terms, non-payment, or any reason at our sole discretion. Upon termination:

  • Your access to the service will cease immediately
  • Stored partial data may be permanently deleted after a reasonable notice period
  • No refunds will be provided for prepaid fees
  • These Terms will survive termination where applicable

9. Intellectual Property

All intellectual property rights in the service, including software, content, trademarks, and documentation, belong to Mario Boss Ltd or our licensors. You may not:

  • Copy, modify, or distribute our proprietary technology
  • Reverse engineer or attempt to extract source code
  • Use our trademarks or branding without permission
  • Create derivative works based on our service

10. Access Upon Death or Incapacity

CRITICAL: Mario Boss Ltd cannot and will not initiate access to your stored information upon death or incapacity. Access must be coordinated by:

  • Your designated legal professional who holds the other part of your crypto will data
  • Properly authorised representatives with legal documentation
  • Court-appointed executors or administrators with appropriate legal authority
  • Beneficiaries following proper legal procedures in your jurisdiction

You are solely responsible for ensuring your legal professional understands our service and can coordinate access when required.

11. Business Continuity and Information Release

In the event that the Company ceases to operate, becomes insolvent, or is otherwise unable to continue providing services for any reason, the Company (or its appointed successor, administrator, or escrow agent) shall make reasonable efforts to provide each designated heir with their portion of the Testator's digital asset access information ("Heir Package") in available form.

Release Limitations and Disclaimers:

  • Information release shall be contingent upon the Company's available resources, operational capacity, and legal constraints at the time of business closure
  • The Company may release information based on available documentation and reasonable belief of the Testator's death, even if full legal verification cannot be completed due to business circumstances
  • Released information may be incomplete, outdated, or partially accessible depending on data preservation capabilities during business wind-down
  • The Company disclaims liability for any losses arising from incomplete or delayed information release due to business closure circumstances

Heir Responsibilities and Legal Obligations:

Heirs acknowledge and agree that:

  • Receipt of access information does not constitute legal authorization to access or use digital assets
  • Independent legal verification of death and inheritance rights remains the heir's responsibility
  • Accessing or using digital assets without proper legal authorization may constitute unlawful appropriation, inheritance fraud, or other criminal violations
  • Heirs must comply with all applicable laws, regulations, and third-party platform terms of service
  • The Company bears no responsibility for legal consequences arising from heir use of released information

No Guarantee of Service Continuity:

The Company makes no warranties or guarantees regarding business continuity, data preservation, or ability to fulfill heir information requests in the event of business closure. This service is provided on a best-efforts basis subject to business viability.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with English law. Any disputes arising from these Terms or the service shall be subject to the exclusive jurisdiction of the English courts.

13. Dispute Resolution

Before initiating legal proceedings, we encourage users to contact us directly to resolve disputes. For formal disputes, you agree to attempt mediation through a recognised UK mediation service before pursuing litigation.

14. Amendments

We may update these Terms at any time by posting revised terms on our website. Material changes will be communicated via email where possible. Continued use of the service after changes constitutes acceptance of the new Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mario Boss Ltd regarding the service.
